Apple Inc. won a victory Thursday in its global patent battle with Samsung Electronics Co. when a judge in Australia issued a temporary injunction blocking the South Korean company from selling its Galaxy Tab 10.1 tablet computer there.

Justice Annabelle Bennett ruled that the Samsung product couldn’t be sold in Australia if it used features such as touch-screen technology that U.S.-based Apple claims infringe patents used in its iPad tablet.

The ruling is a skirmish in a wider global war in which two of the world’s biggest technology companies are vying for supremacy in the US$100 billion market for tablet computers and smartphones. Behind that stands another conflict.

“In the end it’s a battle between Apple and Google,” said Paul Budde, an independent telecommunications analyst. Google Inc.’s Android operating system runs many of the computers and mobile devices that have been the target of Apple’s patent suits.

Mr. Budde called the Australian decision a short-term victory but long-term loss for Apple: “I can clearly see that Apple has a case that it has created some innovative new technology, but on the other hand the reality is we live in an open world and you cannot because of one innovation stop the rest of the world going in similar directions.”

Apple, the world’s biggest technology company by market value, has already persuaded a court in Germany to ban sales of Samsung’s Galaxy Tab in Europe’s biggest economy. Other countries where the two companies have launched patent claims against one another include the U.S., Japan and South Korea.

Samsung hinted it might appeal the Sydney court ruling and vowed to pursue a counterclaim, alleging that Apple infringes on some of its wireless-technology patents. Samsung last week said it will try to stop the sale of Apple’s iPhone 4S in France and Italy, arguing it infringes on patents covering third-generation transmission technology.

“We are disappointed with this ruling and Samsung will be seeking legal advice on its options,” the company said in a written statement. “We will continue to legally assert our intellectual property rights against those who violate Samsung’s patents and free ride on our technology.”

During the hearing earlier this month, Samsung’s lawyers warned that preventing sales of the Galaxy Tab could leave the computer “commercially dead” in Australia, due to the speed of innovation in the market. It would be unlikely for sales to begin in time for the crucial holiday-shopping season, they argued. Apple has sold an estimated 500,000 iPads in Australia, according to a Credit Suisse report in June.

Smartphones are geting bigger and bigger. HTC just announced the Sensation XL, a 4.7-inch, 9.9mm thick Android version of the HTC Titan.

The HTC Sensation XL incorporates Beats audio and includes a set of either Ur Beats in-ear earphones or Solo headphones. The Sensation XL uses a Super-LCD screen with 800 x 480 resolution and is powered by a single-core 1.5GHz Qualcomm MSM8255 Snapdragon processor and 768MB of RAM. It has an 8-megapixel camera with F2.2 max aperture and dual-LED flash. Internal storage is 16GB without a microSD card expansion option.

The HTC Sensation XL will run Android 2.3 with Sense 3.5 and comes preloaded with the Dropbox app for Android.

Pricing is still unknown, release date is early November.

Design and Appearance

The Smart Netphone 701 is made by ZTE and in fact, in other parts of the world, it is known as the ZTE Blade. When I first saw the Netphone, I was certainly not blown away by its design. Holding the unit in my hand, I quickly realized that the Smart Netphone does not aim to compete with the high-end phones currently ruling the Android universe. It’s not a Samsung Galaxy S II or an HTC Sensation wannabe. It’s just an Android phone that aims to be good for its class. The question now is, for the class it aims to be good at, is the Smart Netphone easily the best choice? Is it worth the price tag of P9,900?

Performance

The Smart Netphone uses a 600MHz CPU and it’s sad to say this sometimes shows in the phone’s performance. There are moments when the phone just feels slow, although not to a point that it gets frustrating. The sluggish performance doesn’t show when you are simply navigating the Netphone or scrolling between apps or running a single app, but when you load multiple apps, the phone suffers the occasional stutter. But overall, the phone is a pretty decent handset considering its price.

SmartNet

So the phone is not revolutionary or extraordinary. What then is Smart trying to sell in the Netphone? It’s SmartNet.

SmartNet is a new type of service. If I may make a guess here, Smart is possibly be aware that the next trend in mobile communications is on the social networking and instant messaging front. Text messaging has seen a decline in use while instant messaging and social networking continues to gain popularity. Smart possibly wants to be at the forefront when the shift happens.

SmartNet is a suite of applications that, admittedly, make a Smart user’s life easier and more convenient. Here are the features included in SmartNet.

This feature is quite useful to Facebook and Twitter users. The Social Stream on the Smart Netphone unifies updates in these social networking sites. You can therefore update your status and see all your Twitter and Facebook updates in one screen. These updates are combined with the Netphone’s MyGroups social network.

Global Directory

Global Directory is a form of cloud service. Netphone users can add contacts and friends from SmartNet and other Netphone users and save them in the contacts list. If you’re looking for a friend’s number, all you need to do is find the name in the Global Directory.

Smart Inbox

The Smart Inbox is where Smart’s updates are. It gives you the latest promos, announcements, service offerings, network advisories and advertisements.

Safe Browsing Widget

This feature makes sure that you don’t accidentally use the internet outside of SmartNet. When you’re on safe browsing mode, you can use the features of SmartNet, a few Netphone applications and some websites free of charge. If you click on links that take you out of the SmartNet services, standard internet rates will apply.
